- Family Transfers:Subby retains the right to reassign members between families as necessary.
2. Compensation and Rights
- Compensation Assessment:Subby will determine if compensation is applicable when a member is reassigned to another family.
- Privacy Commitment:We prioritize your privacy and will carefully handle your personal information.
3. Account Security
- Request for Login Details:Subby reserves the right to contact family owners privately for their login credentials when required.
- Password Updates:Family owners must update their passwords whenever a member departs or is removed from their family group.
4. User Responsibilities
- Account Accuracy:Users are responsible for ensuring that their account information is accurate and current.
- Adherence to Terms:Users agree to follow all terms outlined in this document and any additional policies issued by Subby.
5. Dispute Resolution
You can log the issue directly on the platform if you encounter any disputes. For faster resolution, we recommend reaching out to our WhatsApp community for immediate assistance.
6. Termination of Service
- Right to Terminate Access:Subby reserves the right to terminate service access at any time if users violate these terms.
7. Modifications
- Amendments to Terms:Subby may revise these Terms and Conditions at any time. Users will be notified of significant changes, and continued use of the service indicates acceptance of the updated terms.
8. Jurisdiction
- Governing Law:These Terms and Conditions are governed by the laws of Nigeria. Any disputes arising from these terms shall be resolved under Nigerian law.
Limitation of Liability for Subby
In using Subby’s services, users acknowledge and accept the limitations of liability as outlined below. These terms are designed to clarify the extent of Subby’s responsibilities regarding service interruptions and data loss.
1. Service Interruptions
- No Liability for Interruptions:Subby shall not be held liable for any interruptions, delays, or failures in service that are beyond its reasonable control. This includes, but is not limited to, acts of God, natural disasters, power failures, or network outages.
- Notification of Issues:While Subby strives to maintain continuous service availability, users understand that occasional interruptions may occur. Users will be notified of significant service disruptions as promptly as possible.
2. Data Loss
- Limited Responsibility:Subby is not liable for any loss of data resulting from the use of its services. Users are encouraged to regularly back up their data and maintain copies of any important information.
- Data Integrity:While Subby implements reasonable security measures to protect user data, it does not guarantee absolute security against unauthorized access or data breaches.
3. Indemnification
- User Indemnity:Users agree to indemnify and hold harmless Subby from any claims, losses, damages, or expenses that arise from their use of the service or violation of these terms.
- Password Updates:Family owners must update their passwords whenever a member departs or is removed from their family group.
4. Maximum Liability
- Cap on Damages:If Subby is found liable for any damages despite the limitations outlined herein, its total liability shall not exceed the amount paid by the user for the subscription during the three months preceding the claim.
5. Governing Law
- Jurisdiction:These limitations of liability are governed by the laws of Nigeria. Any disputes arising from these terms shall be resolved under Nigerian law.
By using Subby's services, users acknowledge that they have read and understood these limitations of liability and agree to be bound by them.
